Terms & Conditions

Permanent Assignments

Our terms and conditions of business apply to any introduction of personnel by Carnegie Hill Recruitment to the company, person or organisation, hereinafter referred to as the "Client".

Fees

Fees are calculated as a percentage of the candidate's first year's total salary package including base salary, superannuation, shift allowance, penalty rates, special benefits e.g. company car (valued at $12,000 per annum) and any other allowances which are condition of the job specifications.

** Fees to be tailored to the needs of the client

Fees for part time positions will be pro-rata amount of fee for full time position paying same hourly rate.

Any arrangements outside of our 'standard terms' available for exclusive or semi-exclusive assignments, for clients signing Annual Discount Agreements and for other specific arrangements tailored to clients needs, must be in writing and agreed in advance of placement. We are unable to negotiate our fees after successful completion of assignment.

Invoices

Our invoice is raised on the day that the candidate commences employment and is payable within 30 days.

Referral Conditions

Unless amended in writing and authorised by a director of Carnegie Hill Recruitment Pty Ltd. all referrals or resumes are submitted under the following terms and conditions:

Carnegie Hill's referrals and/or resumes remain in force for a period of 180 days after initial contact of the company. A full fee will be due and payable to Carnegie Hill in the event that the candidate is employed on a permanent, part-time, temporary, casual, contract or any other basis by the client, firm or entity receiving this referral/resume, or employed on any basis by any other company, firm or entity as a result of this introduction.

Carnegie Hill's telephone and/or resume referrals are made to companies on behalf of the individual applicants with the express permission and authorisation of said applicants, including indication that such express permission and authorisation to contact a specific company was not given to any other agency and that direct individual contact has not been made. Delivery of resume and/or telephone contact with the client by Carnegie Hill constitutes first applicant authorised contact and such resumes and/or referrals may be cancelled by the company only if cancellation is in writing and is documented by source and date of previous contact, and only if cancellation is made before any interview between the applicant and the client has been arranged.

Guarantee

Assuming that the original invoice is paid in full within 30 days of invoice date, the following guarantee will apply.

If the position is terminated within 5 working days, no fee will be charged.

If a placement lasts less than ninety calendar days, the fee will be reduced to 50% of the normal fee and the balance credited to the clients account.

If for any reason during the ninety calendar day guarantee period a replacement is required and notice of such is given to Carnegie Hill, applicants will be supplied for replacement of the employee, upon selection and employment the original fee paid will suffice for fee value equal to that for the first employee. If the replacement fee is higher the difference in the two fees will be charged. This guarantee is null and void unless invoice for original placement is paid within 30 days of invoice date.

Contract Assignments

Carnegie Hill Recruitment Pty Ltd reserves the exclusive right to negotiate on behalf of the client for the services of persons assigned to clients by Carnegie Hill, regardless of whether the assignee's services are, or are intended to be, in the form of direct employment or contractual or other arrangements for that person's services in the form of an individual, company, partnership, trading name or as any other entity, by the client or any other company, firm or entity as a result of the assignment with client. This right is reserved for a period of 180 days after the last day worked on any past or present assignment or until such time as the client acquires the right to such negotiations by payment to Carnegie Hill of a full and final fee equal to a full permanent fee, except that the guarantee will not apply, based on the standard Carnegie Hill's schedule of fees for the annual remuneration derived from the hourly rate paid said person, company, partnership, trading name or other entity by Carnegie Hill while he/she/it was assigned to the client. The formula for ascertaining the true annual remuneration upon which full and final fee due Carnegie Hill will be determined is: Hourly Rate paid X 38 hours per week X 52.145 weeks per year.

Contract Fees

Hourly and daily rates negotiated individually. Rates include Superannuation, Workers Compensation and other government taxes as applicable.
